Tennessee Attorney General Sides With Biden And Feds Over Tennessee Troops

NASHVILLE, TENNESSEE (January 30, 2024)– FOR IMMEDIATE RELEASE– The Libertarian Party of Tennessee stands against the Tennessee Attorney General, Jonathan Skrmetti’s opinion regarding the constitutionality of HB 1609 which if enacted into law would prohibit the Governor from releasing Tennessee National Guardsmen into active combat overseas without a congressional declaration of war. Skrmetti’s opinion is that the bill is “constitutionally suspect under the Supremacy Clause of the United States Constitution.” He also cites Perpich v. Department of Defense in his opinion, which contradicts his own opinion because it only covers deploying the National Guard overseas for training purposes. We disagree of course, and are on solid ground. While the Federal Government can dictate training, even training that takes place overseas, it CANNOT activate them for other purposes outside the United States without the consent of the Governor. Congress has not declared war against any foreign nation and we reject the President’s desire to send any more of our men and women overseas to die. We call on the Republican supermajority to #DefendTheGuard by voting for HB 1609. We want to let them know, if they are against this legislation, they are standing with Joe Biden.”
